Part 1: Terms & Conditions
Welcome to Momentum (the "Service"), operated by [Legal name] ("we", "us", "our"). By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum legal age in your country, to use the Service. To buy a subscription you must have legal capacity to enter a contract in your jurisdiction. Momentum does not require you to create an account: your profile and history are stored on your own device, and paid access is activated using the email you pay with.
2. Use of the Service and third parties
If you provide a public GitHub username (your own or another person's), you confirm you are accessing publicly available data through GitHub's public API in line with GitHub's terms. We do not use GitHub OAuth and do not access private repositories or source code.
The Service uses third-party large language models (currently Groq) to generate scores, briefs, and recommendations ("Outputs"). All Outputs, including the AI Momentum Score and daily briefs, are for informational and educational purposes only and are not professional, legal, career, financial, medical, or employment advice.
3. Subscriptions and payment (Stripe)
Some features require a paid subscription ("Plus"). Plus is billed on a recurring basis (monthly or annually) as shown at checkout. Payments are processed by our third-party processor, Stripe; by subscribing you agree to Stripe's terms and authorize the applicable charges. You can cancel at any time through the billing portal. Except where required by law, payments are non-refundable.
4. Intellectual property
The Service's design, code, branding, and methods are owned by [Legal name]. You keep ownership of the information you enter. We grant you a non-exclusive, worldwide, royalty-free license to use, share, and export the Outputs for your personal and professional use.
5. Warranty disclaimer and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your use of the Service is limited to the greater of the amount you paid us in the past 12 months or US$100. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service or any AI-generated recommendation. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the greatest extent the law allows.
6. Governing law and disputes
These Terms are governed by the laws of [jurisdiction, e.g. Delaware, USA], without regard to conflict-of-law rules. Disputes will be handled on an individual basis only, not as a class or representative action. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest of the Terms remain in effect.

Part 2: Privacy Policy
What we collect. We collect the minimum needed to run the Service: profile information you enter (role, goals, and an optional public GitHub username); public GitHub data (public repositories, languages, stars, recent activity) retrieved via the GitHub API, without storing raw source code; and limited usage data such as your IP address, used for rate limiting and abuse prevention. Payment data is handled by Stripe: we never receive or store your card details, only transaction metadata such as your email and subscription status.
How we use it. To generate your AI Momentum Score and daily briefs, manage your Plus entitlement and billing, provide support, and secure and improve the Service.
Where your data lives. Your daily-brief profile, history, and reflections are stored locally in your browser on your device, not on our servers. If you create an Evidence Vault account, the evidence you save (wins, feedback, certifications, GitHub snapshots) and your sign-in email are stored in our database (Supabase) tied to your account, so your record persists across devices; each user can only access their own records. Subscription status and coarse usage counters are stored in our key-value database (Upstash). Prompts needed to generate Outputs, including relevant vault evidence when you request a document, are sent server-side to our AI provider (Groq). We do not send passwords or financial credentials to AI providers, and we choose provider settings that, where available, are not used to train third-party models; please verify the current provider terms.
Data architecture and cross-border transfers
Momentum operates a privacy-first infrastructure. Your daily brief inputs, profile settings, and streak habits are stored entirely within your local browser storage and do not persist on our servers.
When you actively use the Evidence Vault, your logged items, GitHub data snapshots, and career achievements are securely stored in our cloud database infrastructure hosted via Supabase in the Asia-Pacific (Seoul, South Korea) region (ap-northeast-2). By using the Evidence Vault, you explicitly consent to the transfer, processing, and storage of this career metadata outside your home jurisdiction.
Your rights (GDPR, UK GDPR, CCPA/CPRA, Singapore PDPA, Philippines Data Privacy Act). If you are in the UK or EEA you may request access to, correction of, or deletion of your personal data. If you are a California resident you may request to know what is collected and to delete it; we do not sell or share personal data with data brokers. We respect equivalent access, rectification, and deletion rights under the Singapore Personal Data Protection Act (PDPA) and the Philippines Data Privacy Act. Our legal bases are performing our contract with you and our legitimate interest in securing and improving the Service. Your information may be processed on servers outside your home country.
Automated decision-making. The AI Momentum Score is for self-reflection and learning. It does not produce legal effects or decisions that significantly affect you under GDPR Article 22, and it is not used to make automated, binding employment or recruitment decisions.
Your rights and data erasure
We keep subscription and billing status while your access is active. Evidence Vault records are kept until you delete them (each item can be deleted in the app) or you ask us to delete your account. To delete data stored on your device, clear your browser storage. While automated self-service account deletion is currently a planned roadmap feature, you may request the immediate, permanent erasure of all your server-side database rows at any time by contacting us at sunnypanjabi@gmail.com. Your data will be completely purged within 30 days of verification.
Part 3: AI Disclaimer
This AI Disclaimer governs all scores, assessments, briefs, and recommendations generated by Momentum ("AI Outputs").
Nature of AI content. AI Outputs are produced by third-party machine-learning systems (large language models via Groq). These models are probabilistic and may generate inaccurate, outdated, incomplete, or speculative information. We make no representations or warranties about the correctness of any evaluation or score. Reference to any technology, certification, or professional body does not imply their endorsement, affiliation, or sponsorship of Momentum.
Career and professional decisions. The AI Momentum Score and briefs are meant to spark reflection and learning, not to replace professional career counseling, recruitment advice, or mentorship. This Service is not designed, intended, or authorized to be used by recruiters or hiring managers to vet, hire, promote, or terminate anyone. You are solely responsible for verifying anything you act on. [Legal name] is not liable for professional setbacks, rejected applications, job transitions, or technical failures resulting from decisions connected to these AI Outputs.
AI generation liability and performance waiver (Evidence Vault documents)
Momentum provides an AI Career Evidence Engine that aggregates your logged evidence to create summaries, resumes, and promotion talking points via third-party language models hosted by Groq. All outputs generated by the document-generation engine (promotion packets, self-reviews, resume bullets, talking points) are strictly for general professional development and informational support.
Momentum does not guarantee promotions, salary increases, or employment outcomes. You retain sole accountability and liability for verifying the factual accuracy, relevance, and truthfulness of any generated career packet before presenting it to current or prospective employers.
